These General Terms and Conditions (hereinafter "Terms") govern the legal relationships from purchase contracts between Medner Germany GmbH & Co. KG, Uhlandstr. 20–25, 10623 Berlin (hereinafter "Medner") and the customer regarding all products, services, and deliveries offered by Medner — both via the online shop at www.medner.de and through direct sales.
Deviating, conflicting, or supplementary general terms and conditions of the customer shall only become part of the contract if and to the extent that Medner has expressly agreed to their application in writing.
A consumer within the meaning of these Terms is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to their commercial nor to their independent professional activity (§ 13 BGB).
An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, is acting in the exercise of their commercial or independent professional activity (§ 14 BGB).
The product presentations, prices, and descriptions contained in the online shop and in offer documents do not constitute a binding offer, but a non-binding invitation to the customer to submit an offer (invitatio ad offerendum).
By submitting the order via the online order form or by written or electronic order, the customer makes a binding offer to conclude a purchase contract. Medner confirms receipt of the order immediately by email. This confirmation of receipt does not yet constitute acceptance of the offer.
The contract is concluded by sending a written or electronic order confirmation by Medner, or by delivery of the goods.
The contract is concluded in German and English. The contract text is stored by Medner and made available to the customer upon request.
All prices are in euros (EUR) and include — unless otherwise stated — the applicable statutory VAT. Shipping costs are shown separately and are to be borne by the customer.

Unless otherwise stated in the item description or the offer, the delivery time for in-stock items is approximately 1–2 weeks from receipt of payment. For customer-configured systems (e.g. POWERCAB, HALOCAB, ARMSTRONG), the delivery times individually agreed in the offer apply.
Shipping is carried out at Medner's choice with suitable shipping service providers (including DHL, Hermes, freight forwarder). For large-volume equipment, shipping is generally carried out by freight forwarder.
Transfer of risk
For consumers, the risk of accidental loss and accidental deterioration of the goods sold passes to the consumer upon handover.
For entrepreneurs, the risk passes upon handover of the goods to the freight forwarder, carrier, or other person designated to carry out the shipment (§ 447 BGB).
Force majeure
Force majeure, pandemics, war, strike, lockout, official orders, energy or raw material shortages, and other events for which Medner is not responsible release Medner from the obligation to deliver and perform for the duration of the impediment.
The delivered goods remain the property of Medner until all claims have been paid in full.
The customer is obliged to handle the goods with care until ownership is transferred. In the event of seizure or other interventions by third parties, Medner must be notified in writing without delay.
Withdrawal instructions
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you, or a third party named by you who is not the carrier, have taken possession of the goods.
To exercise your right of withdrawal, you must inform us (Medner Germany GmbH & Co. KG, Uhlandstr. 20–25, 10623 Berlin, Email: info@medner.de) by means of a clear statement (e.g. a letter sent by post or email) of your decision to withdraw from this contract. You may use the attached model withdrawal form for this purpose, although its use is not mandatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Consequences of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including delivery costs (with the exception of the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract.
For this reimbursement, we will use the same means of payment as you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees as a result of this reimbursement.
We may withhold reimbursement until we have received the goods back, or until you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.
You will bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
